Article premier - Definition of the Regulations
In conformity with Article 14 of the statutes for the association Médicalistes, regulations are established and eventually modified by the Board and are destined to fix diverse points not planned for in the statutes, notably those connected with the internal administration of the association.
The regulations have the same obligatory force for members as the statutes of the association.

Article 2 - Amount for Subscriptions
Currently, the amount for annual subscriptions is fixed as follows:
active members
- individual persons
- level 1 : 15 €
- level 2 : 20 €
- level 3 : 30 €
- legal entities (associations)
- level 1 : 50 €
- level 2 : 100 €
- level 3 : 150 €
supporters
- individual persons: 50 € or more
- legal entities: 300 € or more

Article 3 - Diverse Conditions
The yearly membership for a new member starts on the date of inscription and ends one year later to the day. Subscription must be paid preferably by bank cheque made out to "Association Médicalistes".
For the individual or legal entity who requests it in writing, the Board may accept monthly payment of the subscription, e.g. by direct debit from a bank account in metropolitan France.
In the event of membership rupture by the association or the member, the latter cannot request a credit note, reduction or compensation for the remaining period, excepting under exceptional circumstances at the discretion of the Board.

Article 4 - Conditions for adhering
A person wishing to obtain member status should:
be of age or be represented by a person responsible for them
send a request for admission by post. The form can be:
- downloaded on the association’s website
- sent on request from the association:
- by e-mail
- by telephone or fax to +33 (0)2.98.41.64.59
- by letter to the Association Médicalistes, 2 place Penhélen, F-29200 Brest, FRANCE
the form for adhesion should be completed, dated and signed, and accompanied by a cheque for the amount corresponding to the level and the chosen type of adhesion (cf Article 2 of the regulations).
The new member will then receive:
- a taxation receipt corresponding to adhesion to the association
- the document recapulating the necessary technical data for using the services of the Association Médicalistes and corresponding to the new member’s needs as expressed in the adhesion form
In conformity with the Article 5 of the statutes, the Board of the association reserves the right to accept or refuse a new member.

Article 5 - Services proposed
The association Médicalistes offers the following services to its members but also free of charge to any person concerned by a rare disease, serious or chronic:
French speaking mailing lists (therefore by e-mail) on the subject of rare diseases or syndromes, serious or chronic
A personal e-mail account if necessary or even redirecting to an anonymous address (e.g. a pseudonym at the address medicalistes.org) towards a personal e-mail address, namely with the aim of confidentiality
Web hosting with a PHP support and a MySQL daily statistics data base
Domain hosting (examples: domain-name.org, domain2.net, another-one.com, sainou.asso.fr, society. info, etc...)
Eventual assistance on a technical plan between association members.
Disc-space occupied by a user on the association’s server is not strictly limited, but at 50 MB, it is subject to approval from the technical team, under arbitrage from the Board.
Médicalistes reserves the right to refuse to host a site or a list without any obligation to give a reason.
It is generally understood that the user must have or have access to a computer with the tools and/or peripheries and/or software permitting access to knowledge and use of e-mail information.

Article 6 - Distribution & responsibilities - Netiquette & Ethics
The user alone is responsible for what he/she has written or done. All transfer of information or files by use of electronic mail or the web remains the responsibility of whoever sent the message or of the person editing the content. The association is in no way responsible for distribution of data and information, and cannot be declared as such in any dispute whatsoever. A subscriber could never become an official re-distributor of the association without the express written consent of the Board.
Moreover, any person distributing information via a blog, a site, a list or a forum must respect the rules of intellectual property, namely:
by indicating the source and the authors of a reproduced document
by ensuring authorisation of the authors of the reproduced document.
The mailing lists hosted by Médicalistes all have a point in common: respect for certain values and certain morals. Without falling into raw Puritanism with no concessions, the message content posted on a Médicalistes mailing list cannot in any manner comprise anything of a pornographic or pedophile nature, or of a political or religious extremist nature, which is against legislation in force or to the Rights of Man. This is as valid for web sites hosted by Médicalistes, as well as for documents relative to the lists and to which their subscribers have access in reading and in writing. Breaking these rules will lead to immediate striking off, definitive and without appeal from the subscriber or the webmaster of the hosted site.
The association, by the intermediary of its technical team mandated by the Board, reserves the right to:
suspend certain transfers which might endanger the communication network without letting the user - senders know at the time.
suppress a public contribution (web page, file, contribution to a mailing list, etc...) which might endanger the functioning of the association, which might not be in conformity with the code of ethics proper to not for profit associations regulated by the law called 1901, or which might contravene the law regulating them
suspend the account of a user who risks endangering the functioning of the association
Any intervention of this kind must be accounted for with the Board and the concerned user, in the form of electronic mail or/and a written report.
Each mailing list is hosted under the direction of a listowner. This person is there to help subscribers who request it (subscribe, unsubscribe, access to archives, diverse questions, etc...) but the listowner is also there to check on respect for Netiquette of the list in question. Netiquette assembles the simple rules to respect when one is subscribed to a mailing list.
On the association’s website you can consult a generic version of Netiquette, but the version to be respected in priority is the one written by the listowner of each list. It is shown in its entirety on the home page of the list in question, and also in the message which is sent by the server with each new inscription, as well as simply on request.
Breaking the rules of Netiquette seriously or repeatedly despite the often courteous and helpful reminders from the listowner of a list can lead to a user being struck off, with the aim of simply protecting other subscribers.

Article 7 - CNIL, personal data, medical secrecy
In conformity with the Law N° 78-17 of 6 January 1978, named the Law for Computers, Freedom and Privacy, users have the right to consult, modify, and to remove all personal data given by them on the Médicalistes server at the time of their application to a mailing list or to any other service.
The lists accessible to each and everyone are generally consecrated to rare diseases, serious or chronic. In so much as they all concern a health problem in particular, the list of subscribers to a given list is known to his/her or their listowners, and to him/her/them alone. The list will not be distributed to anyone, either on a mailing list, or on a Médicalistes web site, or by any other means of communication whatsoever.
A subscriber posting a contribution to a list must be conscious of the fact that the message is read by all or a part of its subscribers (ten or so to several hundreds), the majority of them, it is true being concerned by the subject of the list. Médicalistes guarantees a maximum degree of confidentiality concerning individual data given by subscribers, within *this* limit.
Most of the lists hosted by Médicalistes have a photo gallery. Access is through the security of a login and a password which are not made known to a visitor unless he/she is subscribed to the list in question. Only subscribers who wish are shown; they can be removed by a simple request to their listowner.
All messages posted to one of the mailing lists hosted by Médicalistes can have no other aim but to be informative, and can in no case be assimilated to medical advice. All information relative to therapy or a diagnostic must be taken with reserve as only the doctor of the person destined for such information is authorised to confirm its validity.

Article 8 - Security and guarantees
The association is committed to ensuring optimum functioning of its services, but in conformity to uses on the Internet network in effect, it cannot be held responsible for any non-functioning whatsoever of the information system it proposes. The user or the member cannot therefore ask for a discount, or credit note or compensation in the event of an interruption to the services proposed.
The user alone is responsible for his/her machine and work environment. Any incorrect installation on the user’s computer, computer virus, or other cannot therefore be a reason for complaint of any kind against the association.
The association cannot ensure a maintenance service of any kind and the upkeep and proper functioning of the machine(s) will be the entire responsibility of the users.

Article 9 - Installation and configuration of the user’s work station
The user must install the necessary tools for using the services proposed by the association Médicalistes, and define its configuration.
However the association may, within its means and in a non-contractual manner, give advice to the user for configuring his/her machine and the person may benefit namely from advice from other users or association members.
Different ’user codes’ (or ‘usernames’ or even ’logins’) and passwords will be given to the user by the association so as to permit proper use of the services proposed by Médicalistes.
The user is committed to using these individual codes officially given by the association for his/her proper use. The person is also committed to not giving out the code, and to not using the code of another user.
Any act of fraud remarked by the technical team will be severely punished by the association: The user will have his/her account suspended and the Board will request that the person be struck off the list. In conformity with article 6 of the statutes, the person will be informed by electronic mail, and if need be, by registered delivery letter, and may explain the acts by stating the situation to the Board.

Article 10 - Financial commitments
With reference to article 8 of the statutes, any transaction for which the amount is above the sum of 150 € must be voted on by the Board.

Article 11 - Availability of these Regulations
These regulations are made available to the public on the association’s website from its implementation. All users can obtain a printed duplicate on paper (and the same for the statutes) by simply requesting it by letter with an enclosed a SAE. The address is:

Article 12 - The Headquarters of the Association
With reference to article 3 of the statutes, the association’s headquarters are situated at 2, Place Penhélen, 29200 Brest France.

Article 13 - Organisation of meetings by electronic means
With reference to articles 9 and 11 of the statutes, meetings for the different groups of the association (The Committee, The Board, Ordinary and Extraordinary Assemblies) can be held electronically. Meetings are announced by e-mail to the different members with details of the agenda, the date of the meeting, and the planned timing for the end of voting.
Votes follow the same rules as for meetings held in physical presence, and can take place either on the mailing list dedicated to the meeting, or by using an on-line tool after authentication of voters.
Meetings then take place by e-messaging on the dedicated mailing list, according to the usual conditions for management of these meetings. These are simply spread over time in proportions which are up to the discretion of the organ which organised the meeting in the first place (most often, the Board). Voting will be done by an on-line tool on the Médicalistes website after authentication of voters by their username and their access code.
